The Office of Federal Contract Compliance Programs (OFCCP) issued a final rule implementing Executive Order 13665 promoting pay transparency, which took effect January 11, 2016. The rule prohibits federal contractors and subcontractors from discriminating against employees and job applicants who inquire about, discuss or disclose compensation information.

“EEO is the Law” Poster Supplement
When the OFCCP issued the final rule promoting pay transparency they also issued a mandatory supplement to the “EEO is the Law” poster which incorporates the changes to EO 11246 in which sexual orientation and gender identity became protected classes along with the pay secrecy clause. Class Member Locator
The OFCCP launched a website designed to locate employees and applicants who may be class members of existing Conciliation Agreements (CA). The site has a video, FAQs and details on recent Conciliation Agreements in an easy online format. Viewers of the video are asked to review the class member database and contact OFCCP if they may be part of an affected class.
By the way, there is no negotiating your way out of your company’s CA being published on this website if your Agreement includes financial remedies for discrimination. So signer beware. Click here to go to Class Member Locator website.

OFCCP seeks to answer contractors, employees and applicants’ questions as to who is a protected veteran under the Vietnam Era Veterans Readjustment Assistance Act (VEVRAA), as amended (38 U.S.C. Disability Self-Identification Video: “Disability Inclusion Starts With You”
The OFCCP has released a video encouraging employees and applicants with disabilities to self-identify and understand “the important role that self-identifying plays in ensuring equal employment opportunity for people with disabilities.”

Reasonable Accommodations Pocket Card
OFCCP posted on its website a pocket card that put the process for understanding reasonable accommodations in simple language. It answers these four questions:
- What is a reasonable accommodation?
- How do I request a reasonable accommodation?
- What do I need to tell my employer?
- What happens after the request is made?
